萬達鑛業太白山金礦位在宜蘭南澳大白山一帶，申請擴大開採的時候，預計開發範圍幾乎貼著《文資法》公告的珍稀植物「台灣水青岡」分布點。礦場開挖後的邊坡穩定、地下水脈都可能影響水青岡，因此被要求進入二階環評，但這個程序一直沒有完成，7年後被地礦中心收回礦業權，10年後行政訴訟定讞礦業權真正被廢止。 . 位在花蓮秀林的榮豐大濁水礦場，則是在開發影響範圍內記錄到11種保育類動植物。即便開發單位在審查過程中多次縮減面積、減少開採量，但仍缺乏緩衝帶與邊坡穩定規劃，最後在環評大會上遭駁回。 . 這兩個案子有趣的地方在於，它們的結束，都沒有用到新版的礦業法。 萬達是依照舊版《礦業法》第 38 條——沒有正當理由停工一年以上收回礦業權；榮豐則是在當時的環評制度中被駁回。變化的是行政機關對同一件事情的態度和積極度，在倡議修法的過程中，地礦中心對於停工「正當理由」的正當性變得更嚴格，才收回了萬達的礦業權。 . 所以
