In 2016 Colombia's Constitutional Court (Sentencia T-622) declared the Atrato River a subject of rights after decades of mercury and cyanide contamination from illegal gold mining sickened the river and the Emberá and Afro-Colombian communities who depend on it. To enforce the ruling, the government and river communities created the Comisión de Guardianes del Río Atrato in 2018: a collegiate body of 14 community guardians, drawn from seven ethnic authorities and social organizations across the upper, middle and lower basin, who co-represent the river's legal interests alongside the Ministry of Environment. The guardians monitor mining damage, push for cleanup of the river and its tributaries, and pioneered a model of river-personhood enforcement led by riverine communities rather than the state alone.
